Substitute fulfillment
By cooperating with a registered social enterprise, you can apply for compensation in accordance with Act no. 5/2004 Coll. on employment services. It follows from the law that an organization with 20 or more employees is obliged to employ employees with disabilities (3.2% of the total average number of employees per year).
If she does not meet this condition, she is obliged to pay a levy for non-fulfilment of this share to the Labor Office in the amount of 0.9 times the total cost of work for each absent disabled person (the total cost of work is calculated from the average wage of an employee in the economy of the Slovak Republic for the first to third quarter of the calendar year that precedes the calendar year in which the employer fulfills the obligation to employ a mandatory share of the number of citizens with disabilities). The amount of the levy for non-fulfilment is calculated for each absent employee with ZPS (note: only those employees with ZPS who worked for the employer for at least 6 months in 2022 can be counted). You calculate this amount in the statement once a year and always submit it by March 31 of the following calendar year.
Or the employer can apply for substitute performance in the form of cooperation with a registered social enterprise. For goods and services provided by RSP, the company can deduct 100% of the order price. If RSP buys the goods and then sells them, the company that bought from them can claim 10% of the compensation.
Placing an order and receiving services and gifts for it is cheaper than paying a levy.

At the same time, by employing disabled people in Fandíme Slovakia, you help with their integration into society and their professional and personal development.
From us as RSP, you will receive a confirmation of the completed order, which we will send to you after the invoices have been paid. You attach this confirmation together with a photocopy of the invoice and proof of payment to the above-mentioned statement, and thus you have the right to deduct the amount of the completed order from the reported levy for failure to meet the mandatory share of employees with disabilities.
According to the internal guidelines, the employer is obliged to pay the payment for the goods taken or the service provided no later than March 31 of the following calendar year.
